UK-Based NRI: ₹18 Lakh TDS Refund on Property Sale

≈ ₹18 lakh refund

Situation

An NRI based in the UK sold property in India worth about ₹1 crore, and the buyer deducted TDS at roughly 23% (including surcharge and cess), about ₹23 lakh, without a Lower Deduction Certificate in place beforehand, well above the client's actual capital gains liability.

Approach

We computed the accurate capital gains tax liability, helped the client set up the required NRO/SNRR banking arrangement for refund credit, and filed the Indian income tax return claiming full credit for the TDS deducted, backed by proper computation and Form 26AS reconciliation.

Outcome

The return was processed and the client received a refund of approximately ₹18 lakh, bringing the effective tax down from the ~23% deducted at source to the client's actual liability of around 5%, with no scrutiny delays.
